Welcome to Mercer Homeschooling. These Terms & Conditions (“Terms”) govern your use of this website and the services and products offered by Vida Mercer, operating as Mercer Homeschooling (“we,” “us,” or “our”). By using this site, registering for a workshop, booking a service, or purchasing a product, you agree to these Terms.
1. Use of This Site
You agree to use this site lawfully and not to infringe the rights of others or interfere with the site’s operation.
2. Intellectual Property
All content on this site — including text, images, graphics, logos, videos, curriculum, and digital materials — belongs to Mercer Homeschooling. You may view and print content for personal, non-commercial use. Reproduction, distribution, or resale requires our written permission.
3. Our Services
Mercer Homeschooling currently offers three categories of services, plus digital products. Each has its own terms below:
- In-Person Workshops — group classes and workshops held at a physical location (Section 4).
- Online Tutoring — one-on-one tutoring delivered online (Section 7).
- Consulting — homeschool consulting and planning services (Section 8).
- Digital Products — downloadable resources and materials (Section 9).
4. In-Person Workshops
These terms apply to any in-person group class or workshop offered by Mercer Homeschooling.
Registration & Payment. A spot is reserved upon registration and confirmed upon payment. Payment may be made through an approved ESA vendor payment (via ClassWallet) or by direct payment (e.g., PayPal invoice). Registration is not complete until payment is arranged, and spots are limited.
Refund & Withdrawal Policy
- If you withdraw and notify us by email at least 24 hours before the first session, you will receive a full refund.
- After that point, tuition is non-refundable for a participant’s own missed or unattended sessions. Every family receives the complete written workshop curriculum by email, so missed sessions can be completed on your own time or repeated later.
- If we are unable to hold a session (for example, due to venue closure or instructor illness), that session will be refunded, prorated per session, up to the amount of tuition paid.
- Direct payments are refunded by the original method, less any payment-processing fees already incurred. ESA payments are refunded through the ESA/ClassWallet system rather than as cash.
- In no event will a refund exceed the tuition actually paid.
Attendance & Materials. Written instructions and materials are provided to registered families by email. Participation in in-class activities depends on completing the assigned at-home work beforehand.
Code of Conduct. Participants are expected to treat classmates, the instructor, and the host facility with respect. Repeated disruption will be addressed with a parent or guardian, and a participant may be asked to step out or, in persistent cases, to discontinue the workshop without refund.
Health. Please keep participants home if they are unwell. Any allergies or needs should be disclosed at registration.
5. Supervision, Drop-Off & Assumption of Risk — In-Person Workshops
By registering a participant for an in-person workshop, the parent or legal guardian acknowledges and agrees:
- Supervision is limited to the classroom during scheduled class time only. The instructor does not supervise participants before or after class, or if a participant leaves the room (for example, to use the restroom). Parents/guardians are responsible for drop-off, pickup, and their child outside of class time.
- A parent or guardian must provide a phone number at which they can be reached during class and must remain reachable for the duration of each session.
- Assumption of Risk. Participation in an in-person workshop carries inherent risks. To the fullest extent permitted by law, the parent/guardian assumes those risks and agrees that Mercer Homeschooling and Vida Mercer are not liable for injury, illness, loss, or damage arising from participation, except to the extent caused by our gross negligence or willful misconduct.
- Release. To the fullest extent permitted by applicable law, the parent/guardian releases and agrees to hold harmless Mercer Homeschooling and Vida Mercer from claims arising out of the participant’s attendance, except as stated above.
- Our total liability relating to a workshop will not exceed the tuition paid for that workshop.
6. Photo & Media Release — Optional
At registration, you may choose whether to grant permission for photographs or video that include your child to be used in Mercer Homeschooling promotional materials. This permission is optional and is not required to participate. You may withdraw it at any time by emailing us; withdrawal applies to future use.
7. Online Tutoring
One-on-one tutoring is currently offered online only. Sessions are scheduled by appointment. Please provide at least 24 hours’ notice to reschedule a session; sessions cancelled with less notice, or missed without notice, may be forfeited. Specific tutoring engagements may be subject to additional agreed terms.
8. Consulting
Consulting services are provided by appointment. Cancellations require at least 30 days’ advance notice; cancellations within 30 days may result in forfeiture of retainers or prepayments. Individual consulting engagements may include additional terms.
9. Digital Products & Downloads
Digital products are licensed, not sold, for personal, non-commercial household educational use, and are non-transferable. Because of their nature, all sales of digital products are final — no refunds or exchanges once a product has been delivered or accessed.
10. Payment
Fees are due in full at the time of purchase or as otherwise stated for a given service. Payments are handled by third-party processors; Mercer Homeschooling does not store your credit card information.
11. Affiliate Relationships
We may recommend third-party products and participate in affiliate programs, including the Amazon Associates Program, earning commissions at no additional cost to you.
12. Educational Disclaimer
All content and services are informational and educational only and do not constitute legal, financial, or medical advice. You are responsible for complying with the homeschooling laws of your state or locality.
13. Limitation of Liability
Except as stated in Section 5, our services and products are provided “as is,” without warranties of any kind. To the fullest extent permitted by law, Mercer Homeschooling and its owner shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim will not exceed the amount you paid for the applicable product or service.
14. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in Arizona.
15. Changes to These Terms
We may update these Terms at any time. Continued use of the site or our services after changes are posted constitutes acceptance of the updated Terms.
